[Building Sakai] Spring 3, Sakai 2.9 kernel 1.3 issues

Hello all,
Am trying to deploy a tool into 2.9, kernel 1.3. Its a spring 3.1.1
application.
Now, this line in web.xml:

<listener-class>org.sakaiproject.util.ContextLoaderListener</listener-class>

 is throwing :

java.lang.IllegalStateException: Context attribute is not of type
WebApplicationContext:

Does this Sakai version support Spring 3 apps ( i imagine it should)...or
am i doing something wrong ?
