[Building Sakai] Errors in evaluation 1.2.1 or an upgrade to 1.3.x

I'm having some issues on a 2.6.2 install using evaluation 1.2.1.  It has been suggested that I use the 1.3.x version but it seems like it needs java 1.6…is that anything that someone can confirm?  I'd hate to have to upgrade java just so I can run a newer version of the evaluation tool!
The reason for the upgrade is due to the attached error.  Supposedly folks can't add more than 2 questions to a template.  This screenshot shows the message in the UI and the attached file is in the logs.  Anyone have any tips?
